This policy explains how Daromav Spedition collects, uses and protects personal data in accordance with Regulation (EU) 2016/679 (GDPR) and the applicable national legislation. Our transport and freight forwarding activity (road, refrigerated, oversized, ADR, FTL/LTL, air, rail-intermodal and sea) involves the processing of personal data of customers, partners and drivers, which we handle with the utmost responsibility.

Depending on the relationship we have with you, we may process the following categories of data:

  • Identification and contact data: first name, last name, company name, position, VAT number, address, email, phone.
  • Billing data: tax name, VAT number, bank account, billing address.
  • Transport-related data: loading/unloading addresses, contact persons, data about the goods (type, weight, dimensions, CMR value).
  • Data about drivers and vehicles: driver's name, driving licence number (categories), registration number, ADR certificates, GPS location data of the means of transport.
  • Technical data: IP address, browser type, pages visited (when you use our website).

3. Purposes of processing

The data is processed exclusively for:

  • concluding and performing transport and freight forwarding contracts;
  • issuing quotes, invoices and transport documents (CMR, AWB, B/L, etc.);
  • operational coordination of transports and communication with customers, drivers and partners;
  • GPS monitoring of the means of transport for the safety of the goods and personnel;
  • compliance with legal obligations (tax, customs, excisable goods transport, SUMAL for timber);
  • handling claim files under the CMR insurance policy (EUR 1,500,000);
  • responding to requests submitted through the website forms or by email.

We process your data based on:

  • the performance of a contract or in order to take pre-contractual steps (Art. 6(1)(b) GDPR);
  • legal obligations incumbent upon us (Art. 6(1)(c) GDPR) — tax, accounting, ADR transport, excisable goods, SUMAL, etc.;
  • legitimate interest (Art. 6(1)(f) GDPR) — transport safety, fraud prevention, debt recovery;
  • your consent, where applicable (Art. 6(1)(a) GDPR).

5. Recipients of the data

The data may be transmitted, strictly for the purposes set out above, to:

  • partner carriers from our portfolio (over 200 active partners), when we subcontract the trip;
  • public authorities (ANAF, Customs, ARR, Forest Guard, ITM, etc.) when required by law;
  • insurance companies, in the case of CMR claim files;
  • IT, accounting, GPS monitoring and customs forwarding service providers, under confidentiality agreements.

6. International transfers

We operate transports in Romania, the European Union and the United Kingdom. For transports to the UK or other countries outside the EEA, the data necessary for carrying out the transport (data about the goods, sender, recipient, driver, vehicle) may be transferred to partners, customs officers and authorities in those countries, exclusively for the purpose of performing the transport.

7. Storage period

We retain personal data for the period necessary to fulfil the purposes for which it was collected and thereafter for the period required by financial-accounting, tax and archiving legislation (as a rule, 10 years for supporting documents). GPS data relating to transports is retained for the operational period necessary for tracking the trip and resolving any disputes.

8. Your rights

Under GDPR, you have the following rights:

  • the right of access to the data processed;
  • the right to rectification of inaccurate data;
  • the right to erasure of data ("the right to be forgotten"), under the conditions provided by law;
  • the right to restriction of processing;
  • the right to data portability;
  • the right to object to processing;
  • the right to withdraw your consent at any time, without affecting the lawfulness of prior processing;
  • the right to lodge a complaint with the National Supervisory Authority for Personal Data Processing (ANSPDCP) (www.dataprotection.ro).

9. Data security

We apply appropriate technical and organisational measures to protect data against loss, unauthorised access, disclosure or alteration. Access to the data is granted only to authorised personnel, based on the need-to-know principle.
